In January of 2002, the Florida Supreme Court ruled in: Woodside Village Condo. Assoc, v Jahren, that every purchaser of a condominium, purchases "with knowledge of the Condominium Property Act and that the Declaration governing their unit was subject to amendment and in the absence of a provision, either in the amendment or the original declaration, condominium owners do not have the vested rights in the status quo ante." The court went further by saying, "people acquire units in condominiums are on constructive notice of extensive restrictions that go with this unique, and some would say, restrictive form of residential property ownership and living." In short, a condominium association can limit your ability to rent out your condo.
