Closing Not Scheduled

Q: - "My real estate agent called and told me that a closing had been scheduled for the sale of my property. I appeared at the closing ,and did so at considerable expense. When I got there I was informed that no closing had actually been scheduled. Can I hold the real estate agent liable for my travel expenses?"

A: - Unless your expenses were very high, it would not be worth your trouble to file suit.

I recommend that you speak to the agent's broker. Explain the situation to the broker and show the broker the bills. A reputable broker will deduct the expenses from the commission the broker expects to receive at the closing.

When it comes to real estate closings remember the following: (1) Buyers and Sellers do not necessarily have to attend the closing. Closing agents will overnight the documents to you with detailed instructions as to where to sign and what documents need to be witnessed and or notarized. (2) Real estate agents do not schedule closings. Closing times and dates are dictated by the contract, and by the title insurance company or attorney that prepares the closing documents. It is unfortunate that on occasion an inexperienced real estate agent will try to speed up the process, (so they can get paid), by pushing the parties to a closing table before the documents are ready.
