Estate Planning, Wills, and Trusts

Mr. Waldron has been assisting clients with Estate Planning for over fourteen years. This experience gives him a broad perspective on what documentation is best for each client's needs. The first goal is to see that the documents are legally binding. The second goal is to advise the client as to tax ramifications, and what steps can be taken to reduce estate taxes. The third goal is supply documents that have the best chance of providing peace of mind for the family during a very difficult time.

It is unfortunate that many people attempt their own version of estate planning by buying documents from various places, such as a book store, over the web or by going to "paralegals" or providers of "non-legal" services. Doing your own estate planning can be very costly to your family later, and can sometimes violate the terms of mortgages, or cause your family to incur gift taxes.

In an effort to avoid probate, people have been known to deed real property to family members or to have family members added to bank accounts. This can be very risky. Florida courts will interpret the deeded property as a gift, and the bank account as a joint account.

In most cases the money that a person thought he saved by drafting his own estate planning documents may later be lost in additional taxes, court costs, legal fees and months of frustration for the family.

Estate Planning is very complicated. If the documents are not drafted properly they will prove to be very costly to the family later for a variety of reasons.
