Probate Services

There are three types of probate in Florida: formal, summary and ancillary. None are simple. Mr. Waldron has been representing clients in probate court for fifteen years. Great emphasis is put on closure for the families. The local circuit court receives numerous petitions for probate every day. If the initial pleadings are not correct, the entire process can be brought to a halt or delayed months. Mr. Waldron provides free consultations on probate matters. Call (321) 725-7077 for an appointment or email at Tom@TomDWaldron.com.

One of the most common mistakes that beneficiaries make is to think that a Will automatically delivers assets to them without probate. Often the beneficiary hires a real estate broker, and contracts for the sale of property he thinks he has inherited without realizing that the property must first go through a probate process at the court, before it can be sold.

A second common mistake is to put the probate off. If one of the decedent's beneficiaries dies prior to the decedent's probate being completed, it will be necessary to probate the deceased beneficiary's estate also.

Mr. Waldron's probate practice combined with the services offered by Lawyers Real Estate, P.A. provides full service for clients' probate needs including the liquidation of real property. Go to www.LawyersRealEstatePA.com for further details.

A third mistake people make is to go to a non-lawyer to have probate documents drafted. It is illegal for "non-lawyers" to assist with court pleadings. Non-lawyers often sell documents that may not get the job done, or may only address part of the assets or part of the liabilities. This can require the probate to be done a second time or even cause the personal representative to become personally liable for the decedents debts.

Estate Planning and Probate are examples of subjects that are best handled by professionals. Just as you would never consider performing a surgical procedure on a family member, you should never try to do Estate Planning or Probate yourself .

If you have inherited real property in Florida, and need assistance in the sale of that property Mr. Waldron and Lawyers Real Estate, P.A. can be of great assistance. Go to www.LawyersRealEstatePA.com for more information.
