Estate Planning usually consists of having a Last Will and Testament or a Revocable Living Trust. This thirty-minute DVD describes the difference between a Last Will and Testament and a Revocable Living Trust.
A Last Will and Testament can be short, but it is never simple. The decedent's family will be required to submit the Will to the Circuit Court. In court there will be a paperwork process called probate.
A Revocable Living Trust is a more modern version of estate planning. Assets that are in a trust are not subject to probate. A Revocable Living Trust usually comes as part of a package of documents, wherein the client states who is to assist him or her in the event that he or she in capacitated, and who will administer the Trust upon the client's death.
This DVD explains, in simple terminology, the basics of Wills and Revocable Living Trust packages. It contains a printable form that will allow clients to organize information to assist their attorney in having a Will or a Trust drafted.
